Terms and conditions

Agreement

This agreement exists between the customer (you) and Wild & Wayward Designs (ABN 38510842393) receives and accepts an order. The order may be accepted by Wild &Wayward Designs at my discretion. Each order is considered as a separate agreement.

Definitions

In these conditions the following terms shall have the following meaning: "The Company" means Wild & Wayward Designs (ABN 38510842393) "Customer" means the customer of the company. "Contract" means any contract for the sale of goods by The Company to the Customer.

Import duties and taxes

You will be responsible for any import duties and taxes on your international order. In addition, some orders may experience customs delays. Unfortunately, we have no control over these charges or delays and cannot predict what they may be. We suggest that you contact your local customs office for additional information.

GST

At this time GST will not be charged. Under Australian law I cannot register or charge customers GST until my business turnover reaches $75,000. This section will be updated with applicable information as it changes.

Delivery

Anyone at the delivery address who receives and signs for the goods shall be presumed by Wild & Wayward Designs to be authorized to receive the goods on your behalf.

Cost

All prices are in Australian Dollars (AUD) The price you will pay is the price specified on the website. You also agree to pay the delivery fees. International customers are responsible for their own countries duties and taxes.

Sale Items

Previous purchases are not eligible for a discount.  Sale items can only be returned for an exchange or credit voucher.

To exchange sale items simply return them to us in their original condition with the original invoice as proof of purchase.

Once received we will issue you with a credit voucher. The voucher will be valid for 6 months for product purchase.

Please use the enclosed returns form to tell us why you are returning the goods and quote your RA number.

Return postage/shipping is at the expense of the purchaser.

Promotions

For any promotion that requires you to spend over a certain amount to obtain the promotion, your order must remain above this minimum spend even after returns are processed. If you are returning items that will drop your order total below the minimum spend you will nominally forfeit your promotional discount or will be charged for any free items you have not returned.

 

Labelling Of Goods

Goods will be sent with tags indicating the full retail price of the garment and with care labels attached. All care instructions should be strictly adhered to as Wild & Wayward Designs declines all responsibility for damage caused to the garments by careless washing or mishandling.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Refund And Return Policy

Wild & Wayward Designs are not required to provide a refund or replacement if you change your mind or have failed to read the product information correctly.

But you can choose a refund or exchange if there is a major problem. This is when the item

-              Has a problem that would have stopped someone from buying the item if they had known about it.

-              Is unsafe.

-              Is significantly different from the sample or description.

-              Doesn’t do what it was described to do, or what you asked for and can’t easily be fixed.

If the problem is not major, the item will be repaired within a reasonable time.

Please keep your proof of purchase – eg. Receipt/invoice and packaging and tags must also be intact.

Request an exchange, refund or repair procedure.

Return postage/shipping is at the expense of the purchaser. Unless major fault can be proven.

Wild & Wayward Designs are not required to provide a refund or replacement if you change your mind or failed to read the product information correctly.

Damaged Goods

If an item arrives damaged, you must notify me within 48 hours of receipt so I can work with you to arrange a return, replacement, refund or credit. If there is obvious damage to the package upon delivery, please note the condition of the package on the waybill (Photos are great evidence) or refuse the delivery altogether. Please contact me should you ever refuse a shipment. Once goods are in your possession for more than 48 hours, I cannot accept any claims for damage.

If you have a problem with your order please contact via email immediately at jjenortje@wildandwaywarddesigns within 7 days of receipt. You must make contact before any goods are returned. Goods returned without prior authorization will be refused. Merchandise that is pre-approved to be returned must be returned in original, undamaged condition and in its original packaging and at the cost of the sender, including both shipping charges and any brokerage or duty that is applicable. Upon approval for a return, you will be issued an RA (Return Authorization) form via e-mail. This RA form must accompany the returned merchandise and the RA number must be written clearly on the outside of any packages. Returns that arrive without the appropriate RMA documentation will be refused. In circumstances where an item is approved for return after 7 days from receipt, a restocking fee may be charged. Orders paid for by credit card will be refunded as a credit onto the original credit card use for payment.

Items must be unused and unwashed in their original packaging with all tags attached.

Goods will not be eligible for exchange/return if I consider them used or if they are without tags attached.

We recommend that all returns and exchanges be sent using a traceable carrier. Wild & Wayward Designs will not be held responsible for packages not received that were returned without a tracking number.

Your privacy is important to us.

Personal information is collected when an order is made or when you join our mailing list.

Your information will only be used by Wild & Wayward Designs to process your order and to advise you of new products and special offers or events from time to time.

We will not share any of your personal information with third parties other than intermediaries, for example courier companies.

Should you wish to have your details removed from our database please click the unsubscribe link on any emails you receive from Wild & Wayward Designs.

 

Privacy And Security

We are committed to respecting your privacy. We do not sell or disclose our customer information to other sources. During a sales transaction, your credit card information, if submitted, is never stored. Any information we collect from you is solely for the processing of your order. If you choose to sign up for our mailing list, on occasion we will send you targeted marketing information or special product offers. In every marketing email you will have the option to unsubscribe and avoid receiving future emails from us.

Security

All credit card transactions are handled by Paypal and are SSL encrypted and secure. Wild & Wayward Designs does not collect or record any credit card details that you use when purchasing.

Fraud

Wild & Wayward reserves the right to refuse orders from countries that the Australian Governments FATF has deemed a High-risk or Non-cooperative Jurisdictions. If there is a concern with fraud on any order I will take additional verification steps, like requesting the customer to email a copy of their driver's license or ID and the front and back of their credit card. If fraud is suspected the order will be cancelled.
